I take the protection of your personal data very seriously. In addition to risk assessment, I use technical and organisational measures in order to ensure the security of your data to the best of my means. In the following please find the specific details thereof:

Your rights

You have the following basic rights (Art. 12 ff. DSGVO) with regards to your the personal data:

  • Right of information
  • Right of correction or deletion
  • Right of restriction of processing
  • Right of objection against processing
  • Right of data portability

You also have the right to complain to a data protection supervisory authority about the processing of your personal data by me.

If you have given me consent, you can revoke this at any time with effect for the future without affecting the lawfulness of the processing carried out on the basis of the consent up to the revocation. How I collect and use your personal data

Type of personal data I collect and process

The use of my website for information purposes is possible without providing personal data.

As a matter of principle, I only process personal data such as IP addresses etc. to the extent that this is necessary to provide a functioning website. Details see below.

I process personal data such as name, address, e-mail address, telephone number and, if applicable, information regarding your own Feldenkrais training only to the extent necessary for my content and services. You will also receive more details on this below.

As a rule, processing is only carried out with the consent of the user in accordance with Art. 6 §1 lit. a of the EU General Data Protection Regulation (DSGVO). An exception applies in those cases in which it is not possible to obtain prior consent for actual reasons and the processing of the data is permitted by legal regulations, e.g. according to Art.6 §1 lit.d.

Contacting me by telephone

If you call using the contact telephone number provided, I will store your telephone number for the purpose of calling you back. When you call, information about the time, date, duration of the call and the caller's telephone number is automatically collected by my telephone.

If you leave a message on my answering machine, your message will be stored until I have called you back, after which the call log will be deleted.

I will only include your telephone number in my address book if you expressly agree to this. Your telephone number will not be passed on to third parties. In no case will the content of the call be stored.

I make sure that third parties cannot listen in on our conversation. You agree to the described processing of your data-storage from the moment you call me.

Contacting me per email

If you use one of my email addresses to contact me, your personal data transmitted with the email will be stored and processed by me.

All emails are automatically deleted from my server immediately after retrieval and are only processed locally. My professional account is clearly separated from my personal mail traffic. Through various organisational measures, I ensure that they cannot be viewed by third parties.

Your data is used exclusively for processing the content and is usually deleted afterwards. I do keep copies of email communication pertaining to appointments, cancellations or speicfic agreements. Some of these are also archived for taxation records.

Should you contact with me in view of signing up for specific services the legal base is the fulfilment of said contract or a pre-contractual measure.

Your data will not be passed on to third parties, except for those relevant to your registration, such as when you book a seminar which includes accomodation and for taxation purposes.

You can request the deletion of all data other than such which must be retained for legal purposes at any time, by sending an e-mail to kathryn@feldenkrais-humecook.de.

Use of the newsletter function

On my website I offer you the possibility of receiving up-to-date information about my offers via email newsletter.

When registering for the newsletter, your full name and email address are transmitted to me via the input mask. The collection of the user's email address serves to deliver the newsletter. The collection of your name and address serves to facilitate the assignment or retrieval of addresses and to avoid duplicate entries. The collection of other personal data during the registration process serves to prevent misuse of the services or the email address used.

For the processing of your data, your consent is obtained during the registration process in accordance with Art. 6 §1 lit. a DSGVO and reference is made to this data protection declaration.

Alternatively, your email address may be used by me for sending the newsletter in accordance with § 7 para. 3 UWG if you have registered for Feldenkrais offers via my website and have provided your email address. In such a case, the newsletter will only be used to send direct advertising for my own similar goods or services. Of course you can unsubscribe at any time.

Your data collected in these two ways will be used exclusively for sending the newsletter and will not be passed on to third parties.

Your e-mail address and name will be stored in the newsletter database for as long as the subscription to the newsletter is active.

You can cancel the subscription at any time, e.g. by following the link at the end of each newsletter, by unsubscribing directly on my homepage or by asking me via email to delete the entry manually (kathryn@feldenkrais-humecook.de).

Upon unsubscribing, your name and email address will be completely deleted from the newsletter database.

Use of online registration forms

If you register for workshops, seminars and classes via the forms offered on my website, I need personal data from you such as name, address and telephone number. The data requested may vary depending on the offer. In every case, a valid email address is required so that I know from whom the registration originates and so that you can receive your automatic registration confirmation.

The other personal data processed during the submission process serves to prevent misuse of the registration form and to ensure the security of my information technology systems.

The data entered in the input mask will be transmitted to me and stored during the registration process in accordance with Art.6 §1 lit.a, b and f DSGVO on the basis of your voluntarily given consent.

I use this data to process the registration for the courses and seminars specified in the form. If it is evident that you regularly use my offers, I store your basic data in the form of name, address, telephone number and e-mail address locally in the address book of my email programme. This is password protected and not accessible to third parties. I do not use clouds and do not store your data on my email server.

When I want to send specific information relating to a subset of customers I use circular e-mails. For this I always use the "blind copy" function or a "hidden" distribution list so that email addresses are not visible to other recipients.

In the case of external seminars which include accommodation or similar your name, address and contact details will be forwarded to the appropriate third parties. In such cases the protection of your privacy regarding this data passes to them.

Your online registrations will be deleted from my mailbox after they have been transferred to the archive for tax purposes. In accordance with Art. 6 § 1 lit. c DSGVO, I store your registration data in written form for 10 years in a locked cabinet as well as in electronic archives for tax reasons.

You can revoke your consent to the storage of your data, e-mail address and their use for the organisational processing of registrations for classes/seminars at any time by sending an e-mail to kathryn@feldenkrais-humecook.de. Depending on the timing of such revocation it might be that some data needs to remain stored for legal reasoins or it might mean that you can not participate in services offered.

Except in the cases defined above, which are related to the processing of your registration and the fulfilment of my duties, I will never pass on your data to external companies.

Use of online classes in the form of ZOOM meetings

I offer both group and individual Feldenkrais lessons online. For this I use the video chat function of the US provider Zoom VideoCommunications, Inc. https://zoom.us/

The legal basis for the processing of data via "Zoom"-Meeting" (hereinafter: service) is Art. 6 § 1 lit b) DSGVO. I use the service to provide my contractual services, in particular Feldenkrais lessons via video chat. When you register for Feldenkrais lessons online on my homepage, your surname, first name and e-mail address are transmitted to the provider Zoom. You will receive registration confirmations and other formal notifications from no-reply@zoom.com.

Zoom's video chat service is certified under the Privacy Shield. Zoom complies with the global data protection framework and has implemented data protection and privacy practices in its products and processes. You agree to all terms by registering for classes online using the Zoom input mask on my homepage. In addition, before your first class you will be asked to send in your consent using the separate input form on my homepage.


Disclosure of personal data to third parties

Your personal data will not be transferred to third parties for purposes other than those stated in this privacy policy and below.

I will only pass your personal data on to third parties in the following cases:

  • You have expressly given your consent to this in accordance with Art. 6 Para. 1 S. 1 lit. a DSGVO (European Data Protection Act)
  • The disclosure is necessary in accordance with Art. 6 para. 1 p. 1 lit. f DSGVO in order to protect my legitimate interests (in particular the assertion, exercise or defence of legal claims) and there is no reason to assume that you have an overriding interest worthy of the non-disclosure of your data
  • There is a legal obligation for the disclosure pursuant to Art. 6 para. 1 sentence 1 lit. c DSGVO, at the same time as this being legally permissible and necessary according to Art. 6 para. 1 p. 1 lit. b DSGVO
  • In order to process contractual relationships with you

In particular, I would like to point out that your data will be passed on to my tax advisor for book-keeping purposes and in order to fulfil my obligations under taxation law in accordance with Art. 6 Para.1 lit.c DSGVO. Your data is protected here by the general terms and conditions for tax advisors, which entail special conditions of confidentiality.


Confidentiality

FELDENKRAIS® Practitioners are bound by confidentiality. Only such information as is necessary in order to protect the welfare of a person or the general public, or to comply with a legal order, can be released from confidentiality. I am bound by the ethical guidelines of my local German Member Association but also by international ethical stipulations of the Feldenkrais community, in particular in my role as an Assistant Trainer working within Professional Training Programs.

All personal information that you disclose to me in the course of a Feldenkrais lesson or setting is therefore subject to confidentiality in addition to the German Data Protection Act (DSGVO). Any notes I make about your state of health/life history etc. remain as one hand-written copy. I only use your first name to file the notes. These notes are only accessible to me and are not linked to any personal data that could be used by third parties. I keep the notes in a locked cabinet for as long as you work with me. I will destroy the notes after 10 years at the latest.

You can of course ask to dispose of all notes with immediate effect. The easiest way to do this is by email to kathryn@feldenkrais-humecook.de.


Use of the website and creation of log files

In the case of purely informative use of the website, only such personal data as your browser transmits to my server is collected. If you wish to view my website, the following data is technically necessary to display the website and to ensure stability and security (legal basis is Art. 6 para. 1 p. 1 lit. f DSGVO, European Data Protection Act):

  • Browser type and version used
  • Operating system of the user and its interface
  • Language and version of the browser software
  • Internet service provider of the user
  • IP address of the user
  • Date and time of access
  • Content of the request (specific page)
  • Access status/HTTP status code
  • Amount of data transferred in each case
  • Websites from which the user's system accesses our website
  • Websites that are accessed by the user's system via our website

Due to legal regulations, the server is allowed to temporarily store the data and log files. The temporary storage of the IP address (duration of use) is necessary to deliver the website to you. The data is stored until the end of the respective session and then automatically deleted. As this data is absolutely necessary for the operation of the website, you as a user have no possibility to object to the processing.

An evaluation of the data for marketing purposes does not take place in this context. In no case will the collected data be used for the purpose of drawing conclusions about your person.

The legitimate interest follows from the data collection purposes listed above.

I have signed a data processing contract with my internet provider UD-Media, which you can view upon request.

Use of cookies

In addition to the data mentioned above, cookies may be stored on your computer when you use my website in accordance with Art. 6 Para. 1 lit. f DSGVO. These are only used to make my website more user-friendly.

Cookies are small text files that are stored in the internet browser or by the internet browser on the user's operating system when a website is called up. A cookie contains a characteristic string of characters that enables the browser to be uniquely identified when the website is called up again.

Cookies do not cause any damage to your device and do not contain viruses, trojans or other malware. Information is stored in the cookie that arises in connection with the specific end device used. No direct knowledge of your identity can be gained from it.

As a user, you have full control over the use of cookies. By changing the settings in your internet browser, you can deactivate or restrict the transmission of cookies. Cookies that have already been stored can be deleted at any time. This can also be done automatically. If cookies are deactivated for my website, it may no longer be possible to use all the functions of the website to their full extent.

I make every effort to ensure that links I include on my site lead to third party websites which also comply with data protection and security standards. However, I have no influence on other providers' compliance with data protection and security regulations. Therefore, please inform yourself of the applicable data protection measures taken by third parties directly.

SSL encryption

My website uses SSL encryption for security reasons and in order to protect the transfer of your confidential data, such as when using online registration forms.

You can recognise an encrypted connection by the fact that the address line of the browser changes from "http://" to "https://" and by the lock symbol in your browser line. If SSL encryption is activated, the data you transmit to me cannot be read by third parties.


Conclusion

In addition to the above, I use appropriate technical and organisational security measures to protect your data against accidental or intentional manipulation, partial or complete loss, destruction or against unauthorised access by third parties.

My security measures are continuously improved in line with technological developments and legal reqirements. Nevertheless, I would like to point out that data transmission on the Internet (e.g. communication by e-mail) can have security gaps. Complete protection of data against access by third parties is not possible.

I hope that I have conscientiously demonstrated my handling of your data and that I have been able to convince you that I am doing my best to ensure its protection.
